FLEXIBLE HR SOLUTIONS TALENT SOURCING AND RECRUITMENT
TERMS AND CONDITIONS OF BUSINESS AGREEMENT
GENERAL:
These terms and conditions are agreed between FLEXIBLE HR SOLUTIONS (The Consultant) and the Employer (The Client, including all subsidiary and associated companies, businesses, and associations) seeking to engage an applicant or candidate (The Applicant) for any form of employment with the Client.
These terms and conditions are deemed to be accepted by the client by a request to submit applicants for a position or opportunity at the Client.
RECRUITMENT: TERMS AND CONDITIONS OF BUSINESS
FLEXIBLE HR SOLUTIONS (PTY) LTD is a professional human resource management consultancy, who’s main aims are to assist our clients with their employee interface.
We strive to accurately match our client’s staff requirements with suitably qualified, skilled and productive talent. We specifically assess the organisational culture and individual personalities of all recommended employees to ensure that the onboarding process of new employees is as quick and effective as possible.
1. FEES – PERMANENT
- A fee of 10 % (for assignments when Flexible HR Solutions is the sole recruiter) or 12% (where other recruitment agencies or principles are sharing the assignment). This fee is applicable to the total annual remuneration package shall be payable by the client who appoints any person as an employee in whatever capacity, as a result of the introduction, screening, or referral to the client by the Consultant within a period of 12 months of such introduction or referral.
- Annual remuneration package includes all financial and non-financial benefits, including but not limited to free/subsidised accommodation, car, services or insurance policies provided by the company to the employee.
- Should such employee be employed by a subsidiary or any third party associated with the client, the client will still be liable for payment of the full fee.
- The client will be invoiced before, or on, the date on which the applicant starts work and payment will be due within seven days after the starting date. The client will not be charged until the actual employment of a successful applicant.
- The fee mentioned above will be negotiable in case of an agreed ‘exclusive consultancy’ or to reward volume business placed with the consultant or if the full recruitment process is not required, i.e., ‘response handling’.
2. FEES – CONTRACT APPOINTMENTS
- For a contract of 1 – 5 months = 15% of the contract value
- For a contract of 6 – 11 months = 12% of the contract value
- For a contract of 12 months or longer = 10% of the contract value Package = R10 000 per month, contract period = 6 months, charge = 12% of
R10 000 X 6 = R7 200 - The consultant will invoice the client for the agreed contract period.
Should the contractor leave before completion of the contract we will reimburse pro-rata in line with the incomplete part of the contracted employment. - If a contractor is subsequently offered a permanent position, the balance of the normal fee (10% of the annual package associated with the permanent position) will be charged.
- In the event of a temporary assignee of the Consultant being offered and accepting a permanent position within 12 months of the last day of the assignment, the client will be charged the normal recruitment fee applicable
3. GUARANTEE
- Should employment of a candidate be terminated within 3 months after commencement, we will endeavour to replace the candidate at no extra cost. However, if we are not able to find a suitable replacement within 2 months, 50 % of the fee will be refunded.
- To validate this guarantee, payment is required within 7 days of invoice.
- No replacement or rebates will be offered in case of redundancy or retrenchment.
4. ADDITIONAL SERVICES AND FEES
- Flexible HR Solutions has established several avenues for sourcing suitable candidates, but should additional (printed press, etc) advertising be required, then this will be separately discussed and arranged subject to the client carrying the additional costs of such advertising.
- Psychometric testing, criminal and security clearances are not included in the fee above and will be agreed with the client before any costs are incurred.
5. GENERAL
- Flexible HR Solutions (Pty) Ltd, a BEE Level Four Contributor, fully subscribes to the principles of the Employment Equity Act and all other relevant labour legislation.
- We are committed to a complete one-stop service to employers and with the assistance of our carefully selected specialist associates (where necessary), could assist employers with all their human resources needs.
